Waste Clearance Brompton Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Brompton provides waste removal, rubbish collection and related services within our service area. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, business or organisation requesting or receiving the services from Waste Clearance Brompton.

Services means any waste clearance, rubbish removal, bulky item collection, recycling, transportation or related services provided by Waste Clearance Brompton.

Waste means any items, materials or substances presented for removal by the Customer, including household waste, commercial waste, garden waste and bulky items, subject to any exclusions in these Terms and Conditions or under applicable law.

Booking means a request for Services that has been accepted and confirmed by Waste Clearance Brompton.

Contract means the agreement between Waste Clearance Brompton and the Customer for the provision of Services, incorporating these Terms and Conditions.

2. Scope of Services

Waste Clearance Brompton provides waste clearance and collection services for domestic and commercial customers. Services may include removal of general waste, furniture, appliances, garden waste and other non-hazardous materials, subject to assessment.

All Services are subject to availability and the suitability of the waste for collection. Waste Clearance Brompton reserves the right to refuse any item or load that, in its reasonable opinion, is not safe, lawful or practical to handle or transport.

3. Booking Process

3.1 Customers may request a booking by telephone, email or through any booking method made available by Waste Clearance Brompton from time to time.

3.2 At the time of requesting a booking, the Customer must provide accurate information about the type, volume and location of the waste, along with any access restrictions, parking considerations or other relevant details.

3.3 Waste Clearance Brompton will provide an estimate or quotation based on the information supplied. This estimate may be revised if the actual waste type, quantity or access conditions differ from those described at the time of booking.

3.4 A booking is only confirmed when Waste Clearance Brompton has accepted the request and provided confirmation to the Customer. Confirmation may be given verbally, in writing or electronically, depending on the method of booking.

3.5 The Customer is responsible for checking the details of the booking confirmation and must inform Waste Clearance Brompton immediately of any errors or changes required.

4. Access, Parking and Customer Responsibilities

4.1 The Customer must ensure that Waste Clearance Brompton has safe and reasonable access to the collection location on the agreed date and time. This includes ensuring that any gates, doors or access routes are unlocked and unobstructed.

4.2 The Customer is responsible for arranging and paying for any necessary parking, permits or access permissions required for our vehicles and staff to carry out the Services.

4.3 If access is delayed, restricted or unsafe, Waste Clearance Brompton may at its discretion:

a. Charge waiting time at a reasonable hourly or part-hourly rate; and/or

b. Refuse to complete the Service and treat the visit as a cancellation by the Customer, in which case applicable cancellation or call-out charges may apply.

4.4 The Customer must ensure that any waste to be collected is clearly identified, safely accessible and not contaminated with hazardous or prohibited materials.

5. Pricing, Estimates and Quotations

5.1 Prices for Services may be provided as fixed quotations, load-based pricing, weight-based pricing or hourly rates, depending on the nature of the work.

5.2 Any quotation provided prior to attendance is based on the Customer's description of the waste and access conditions. If, upon arrival, the actual waste or conditions differ from those described, Waste Clearance Brompton reserves the right to adjust the price to reflect the actual scope of work.

5.3 Waste Clearance Brompton will inform the Customer of any change to the price before proceeding with the work. If the Customer does not accept the revised price, the Service may be cancelled, and a reasonable call-out charge may apply to cover attendance and administration costs.

5.4 All prices are stated in pounds sterling and may be subject to applicable taxes, which will be clearly stated where relevant.

6. Payments

6.1 Unless otherwise agreed in writing, payment is due in full on completion of the Service and prior to departure from the collection address.

6.2 Payment methods accepted may include cash, debit card, credit card or bank transfer, subject to availability at the time of Service. Waste Clearance Brompton reserves the right to amend accepted payment methods from time to time.

6.3 For commercial or account Customers, alternative payment terms may be agreed in writing. Where such terms are agreed, invoices must be settled in full by the due date stated on the invoice.

6.4 If payment is not received by the due date, Waste Clearance Brompton reserves the right to charge interest on the overdue amount at the statutory rate, as well as reasonable debt recovery costs, until payment is received in full.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving reasonable notice before the scheduled collection time. Notice must be given by telephone or email using the contact details provided by Waste Clearance Brompton.

7.2 If the Customer cancels with less than 24 hours notice, or fails to be present or provide access at the agreed time, Waste Clearance Brompton may charge a cancellation or call-out fee to cover costs incurred.

7.3 Waste Clearance Brompton reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness or safety concerns. In such cases, the Customer will be offered an alternative appointment, and any prepaid amounts for Services not delivered will be refunded or credited.

7.4 If the Customer repeatedly cancels or reschedules bookings without reasonable cause, Waste Clearance Brompton may decline future booking requests.

8. Waste Types, Exclusions and Regulations

8.1 Waste Clearance Brompton operates in accordance with applicable UK waste management legislation and guidance. All waste collected is transported and disposed of through authorised facilities, with a focus on reuse and recycling where reasonably practicable.

8.2 The Customer must not present hazardous, dangerous or prohibited materials for collection unless expressly agreed in advance and in compliance with relevant regulations. Prohibited materials typically include, but are not limited to, certain chemicals, asbestos, gas cylinders, clinical waste, explosives and other specialist or regulated waste streams.

8.3 If hazardous or prohibited materials are discovered within the load without prior agreement, Waste Clearance Brompton may:

a. Refuse to collect some or all of the waste;

b. Charge additional fees for handling, specialist disposal or vehicle decontamination; and/or

c. Return any such materials to the Customer or leave them safely at the collection address.

8.4 The Customer is responsible for ensuring that any confidential or sensitive information contained within the waste is removed or destroyed before collection. Waste Clearance Brompton does not accept liability for any loss or misuse of information contained within items presented as waste.

9. Title to Waste and Environmental Compliance

9.1 Once waste has been loaded onto a Waste Clearance Brompton vehicle and payment has been received, title to the waste transfers to Waste Clearance Brompton, subject to any applicable law.

9.2 Waste Clearance Brompton will handle and dispose of collected waste responsibly, using licensed facilities and recycling streams where possible, in line with UK waste regulations and duty of care requirements.

9.3 The Customer agrees to cooperate with any reasonable requests for information relating to the origin, composition or classification of the waste, where this is required for regulatory compliance or safe handling.

10. Customer Warranties

10.1 The Customer warrants that:

a. They are the owner of the waste, or have the full authority of the owner to arrange its removal and disposal.

b. The waste provided for collection is accurately described and does not contain hidden hazardous or prohibited materials.

c. Access to the collection point is safe, suitable and complies with applicable health and safety requirements.

10.2 The Customer shall indemnify Waste Clearance Brompton against any claims, losses, damages or expenses arising from a breach of these warranties or any failure to comply with these Terms and Conditions.

11. Liability and Limitations

11.1 Waste Clearance Brompton will exercise reasonable care and skill in providing the Services. However, except as expressly set out in these Terms and Conditions, all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

11.2 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

11.3 Subject to clause 11.2, Waste Clearance Brompton shall not be liable for:

a. Any indirect or consequential loss, including loss of profit, business interruption or loss of opportunity; or

b. Any loss or damage arising from inaccurate information provided by the Customer or from failure by the Customer to comply with these Terms and Conditions.

11.4 Where damage occurs to property during the provision of the Services, and such damage is directly and solely caused by the negligence of Waste Clearance Brompton, our liability shall be limited to the reasonable cost of repair or replacement of the damaged item, taking into account its age and condition.

11.5 The Customer is responsible for protecting driveways, floors and surfaces if they are concerned about potential marking or wear from vehicles, containers or equipment. Waste Clearance Brompton shall not be liable for superficial marks or wear and tear reasonably associated with the provision of waste clearance services.

12. Missed Collections and Service Delays

12.1 Waste Clearance Brompton aims to attend all bookings within agreed time windows but cannot guarantee arrival times. Time estimates are provided in good faith and may be affected by traffic, weather and other operational factors.

12.2 If Waste Clearance Brompton is unable to attend a booking within the agreed day due to circumstances within its control, the Customer will be offered an alternative time or date. Any prepaid amounts for Services not delivered due to our cancellation will be refunded or credited.

12.3 Waste Clearance Brompton shall not be liable for delays or failure to perform the Services due to events beyond its reasonable control, including but not limited to accidents, road closures, extreme weather, strikes or other force majeure events.

13. Complaints and Disputes

13.1 If the Customer is dissatisfied with any aspect of the Service, they should notify Waste Clearance Brompton as soon as reasonably possible, providing details of the issue and any supporting information.

13.2 Waste Clearance Brompton will investigate complaints in a fair and timely manner and will seek to resolve them by repair, re-service, partial refund, full refund or other appropriate remedy, depending on the circumstances.

13.3 If a dispute cannot be resolved directly, the parties may consider alternative dispute resolution. These Terms and Conditions do not affect any statutory rights the Customer may have.

14. Data Protection and Privacy

14.1 Waste Clearance Brompton may collect and process personal data relating to the Customer for the purposes of arranging and providing the Services, processing payments, handling enquiries and complying with legal obligations.

14.2 Personal data will be handled in accordance with applicable UK data protection laws. Waste Clearance Brompton will take reasonable steps to keep personal data secure and will not sell personal information to third parties.

15. Changes to Terms and Conditions

15.1 Waste Clearance Brompton reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified to the Customer.

15.2 The version of the Terms and Conditions applicable to a particular booking will normally be the version in force at the time the booking was confirmed.

16. Severability

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed from the remainder of the Terms and Conditions, which shall continue to be valid and enforceable.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Clearance Brompton.
